1. Scope of Services

This agreement covers the following services provided by Kushala Yoga Ltd. (“Kushala Yoga” or “the Studio”):

  • Yoga classes (in-person and online)
  • Workshops
  • Teacher training programs
  • Special events
  • Retail merchandise (including yoga mats, props, and other retail items)
  • Online classes and resources

2. Payment Terms

2.1 One-Time Transactions

One-time membership fees, workshop fees, and merchandise purchases are processed as one-time transactions.

2.2 Recurring Payments

Subscription-based memberships are billed automatically on a recurring basis (monthly, every 6 months, or every year). Failure to make a payment within 7 days will result in the suspension of the membership until payment is received.

3. Refund and Cancellation Policy

Refunds, where applicable, will be processed within 7-10 business days.

3.1 Memberships

Membership fees are non-refundable. You can cancel a recurring membership at any time. When you cancel a recurring membership, it continues to be valid until the payment anniversary date. Membership fees will not be prorated upon cancellation.

3.2 Workshops

Workshop fees are refundable up to 24 hours before the scheduled workshop. Refund requests made within 24 hours of the workshop start time will not be honoured.

3.3 Merchandise

  • Yoga Mats and Props: Non-refundable once removed from packaging.
  • Other Merchandise: Can be returned within 30 days of purchase with a receipt, provided the item is in its original condition.

4. Other Terms

  • Validity: All memberships are valid for drop-in classes offered by Kushala Yoga only.
  • Usage: Memberships can be used by the account holder only and cannot be shared.
  • Class Cancellations: Classes can be cancelled up to 2 hours in advance.
  • No-Shows: No-shows will be deducted from your pass as if you attended (-1 visit). The pass used to reserve the class will be debited. If you have an All Access Pass or Introductory Pass, a $10 no-show fee will be charged to your default payment method.
  • Activation Date: All passes must be activated no later than 6 months after their purchase date, or as specified by promotional terms. If a pass is purchased with a renewal discount, it will be automatically activated within 1 week of the previous pass’s expiration date.
  • Extensions and Holds: Passes will not be extended past their expiry date or put on hold (see Exceptions).
  • Transfers: Passes may be transferred once to another individual. The original expiry date applies to the transferred pass.
  • Exceptions: If a medical condition prevents you from using your pass by its expiry date, please email inquiry@kushalayoga.com. Children under 18 may use their parent’s Punch Card only (not Shala, Flex, or All-Access Memberships).

5. Respectful Conduct and Right to Refuse Service

Kushala Yoga Ltd. is committed to providing a safe, welcoming, and respectful environment for all members, staff, and patrons. By using our services, you agree to:

  • Treat all staff, instructors, and fellow members with respect and courtesy.
  • Refrain from any behaviour that is discriminatory, harassing, abusive, or disruptive.

Right to Refuse Service:
Kushala Yoga Ltd. reserves the right to refuse service, suspend, or cancel memberships if a member exhibits disrespectful or inappropriate behaviour towards staff, instructors, or other patrons. Such decisions will be made at the sole discretion of Kushala Yoga Ltd. and may not be eligible for refunds.

6. Age Restrictions

Individuals under the age of 18 require parental or guardian consent for any payments or memberships.

7. Account Suspension for Non-Payment

Memberships will be suspended if payment is not received within 7 days of the due date.

8. Privacy and Data Protection

Payment information is processed securely, and Kushala Yoga Ltd. does not store sensitive payment details.

9. Force Majeure

In the event of unforeseen circumstances beyond the control of Kushala Yoga Ltd. (such as natural disasters, public health crises, or other force majeure events), the Studio reserves the right to modify or suspend services without liability.

10. Online Class Access and Use

  • Access: Online classes and resources are available through our website. You are responsible for ensuring you have a stable internet connection and compatible devices.
  • Personal Use: Online classes are for personal use only. Sharing login credentials or distributing content is prohibited.
  • Technical Issues: Kushala Yoga Ltd. is not responsible for technical difficulties or interruptions caused by your internet service or device.

11. Health and Safety Disclaimer

  • In-Person Classes: By participating in in-person classes, you acknowledge that yoga involves physical activity and assume all risks associated with participation. Please inform instructors of any medical conditions or injuries before class.
  • Online Classes: Ensure you have a safe environment for practice. By participating in online classes, you agree that you are responsible for your safety and well-being.

12. Copyright Notice

Copyright and other relevant intellectual property rights exist on all text relating to the Company’s services and the full content of this website.

14. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia.

15. Dispute Resolution

Any disputes arising from this agreement shall be resolved through mediation. If mediation fails, disputes shall be subject to the jurisdiction of the British Columbia law courts.

16. Amendments

This agreement may be amended by Kushala Yoga Ltd. at its discretion. Clients will be notified of any significant changes.

17. General

The laws of British Columbia govern these terms and conditions. By accessing this website and/or using our services, you consent to these terms and conditions and to the exclusive jurisdiction of the British Columbia courts in all disputes arising out of such access. If any of these terms are deemed invalid or unenforceable, the remaining terms will continue to apply.

18. Acceptance of Terms

By submitting payment or using the services provided by Kushala Yoga Ltd., members acknowledge that they have read, understood, and agree to the terms outlined in this agreement.
